Terms of Use

1. Acceptance

These Terms of Use (“Terms”) are a legal agreement between you and Emery Tech Solutions (“ETS3D,” “we,” “us”) governing your use of the OnSite mobile app and related services (the “Service”). By downloading or using OnSite, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

OnSite is a local-first time-tracking app: it detects when you arrive at and leave the jobsites you create and helps you keep a timesheet. Most of the app works entirely on your device with no account. An optional Team mode lets you connect to an employer and sync your confirmed time entries. How your data is handled is described in our Privacy Policy.

3. Your responsibility for your records

OnSite is a convenience tool. Detection is a prompt, not a system of record on its own — you confirm and can edit every entry, and you are solely responsible for the accuracy and completeness of the hours you record, submit, or rely on. OnSite is not a substitute for your employer’s official timekeeping, and nothing in the Service is payroll, accounting, tax, or legal advice.

4. Subscriptions and billing

The core app is free. OnSite Pro unlocks additional features (such as pay rates and earnings, overtime rules, invoices and payroll export, scheduling, and more) through an auto-renewing subscription. OnSite Team is a separate seat-based subscription for employers who want their team’s hours synced and reviewable.

• Free trial. OnSite Pro may offer a free trial. If you don’t cancel before the trial ends, it converts to a paid subscription at the price shown in the app.
• Auto-renewal. Subscriptions renew automatically for the same period unless canceled at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends.
• Billing & management. App Store and Google Play subscriptions are billed by Apple or Google and managed in your store account settings — you can view, change, or cancel a subscription there at any time. Team plans purchased through the web are billed by our payment provider as shown at checkout.
• Prices. Prices are shown in the app before you buy and may change; we’ll present any change before it applies to you.
• Refunds. Purchases made through the App Store or Google Play are subject to that store’s refund policies; we don’t process store payments directly.

5. Acceptable use

You agree not to misuse the Service — including reverse-engineering it, interfering with its operation, using it to violate any law, or attempting to access another organization’s data. Team-mode organizations may only be used with proper authorization from the organization’s owner.

6. Disclaimer of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that detection, notifications, or sync will be uninterrupted, timely, or error-free.

7. Limitation of liability

To the maximum extent permitted by law, ETS3D will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, wages, or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

8. Changes to the Service or these Terms

We may update the Service and these Terms from time to time. If we make material changes, we’ll update this page and the effective date above. Continued use after changes take effect means you accept the updated Terms.

9. Governing law

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules.
